Terms and Conditions from 17.11.2026
GROUND GAME STORE TERMS AND CONDITIONS
These Terms and Conditions explain the rules for purchasing from us: how to place an order, when the contract is concluded, how much time you have for returns, and what we do if a product is defective. They also describe the services we provide online: your account, newsletter, and reviews.
In addition to these Terms and Conditions, specific terms of promotional campaigns, discounts, and contests may apply to your order if organised by us.
We use "you" to refer to anyone buying from us privately — as well as sole proprietors if the purchase is not of a professional nature for them. Both groups enjoy consumer rights with us — details can be found in the "Sole Proprietorship" section.
If you are shopping as a business entity, e.g. as a commercial company, or if purchases are of a professional nature for you, please proceed to the "B2B Purchases" section.
We use "we", "us", or "our" to refer to GGSPORTS Sp. z o.o. — the company running Ground Game.
What we do with your personal data is described separately in our Privacy Policy, and how we use cookies — in our Cookie Policy.
WHO WE ARE
- These Terms and Conditions apply to the store operating at groundgame.com.
- The owner of the online store is GGSPORTS Sp. z o.o., ul. Budowlana 2S/2, 65-386 Zielona Góra, Poland. District Court in Zielona Góra, VIII Commercial Division of the National Court Register (KRS), KRS 0000861925, Tax ID (NIP) PL9292044002, REGON 387116435, BDO: 000603666, share capital of PLN 6,300 fully paid up.
- You can write to shop@groundgame.com or call +48 796 580 116. The call costs standard operator rates — we do not add any extra charges.
- Returns and complaints are processed at the following address: Ground Game — Salon sprzedaży, Centrum Handlowe Nowy Turzyn, Aleja Bohaterów Warszawy 40, premises 2F1, 70-342 Szczecin, Poland. We also accept complaints by email at shop@groundgame.com.
SHOPPING WITH OR WITHOUT AN ACCOUNT - You can shop as a guest or via an account — the choice is yours. An account remembers your addresses, order history, and makes returns easier.
- To shop, you need an internet-enabled device, a web browser not older than two years (Chrome, Firefox, Safari, Edge, Opera) with JavaScript enabled, and an active email address. We will send all order-related details to this address — make sure there are no typos in it.
- The store uses essential cookies. Without them, the cart will not be remembered and you will not be able to complete the order. We use other cookies only with your consent — details are in the Cookie Policy.
- You create an account by providing your email address and confirming it as indicated in the store: with a one-time code sent by email. By creating an account, you accept these Terms and Conditions. Through your account, you can view your order, return, and complaint history. You can also edit and update your data there independently.
- You may independently make purchases and create an account if you have full legal capacity. If you have limited legal capacity, you must obtain the consent of your legal representative to conclude a service agreement and a sales agreement, and present this consent to us upon request.
- You can delete your account at any time: via the user panel or by emailing shop@groundgame.com. We delete it without undue delay, within 30 days at the latest. Previously placed orders will be processed normally.
- You undertake to provide true and up-to-date data and use the store in compliance with the law and these Terms and Conditions. In particular, it is prohibited to provide unlawful content, place orders using automated tools (e.g. bots), and circumvent promotion limits and conditions.
- In the event of a gross violation of the Terms and Conditions, we may block your account or terminate the account agreement with a 7-day notice period. However, we will first contact you and give you 3 days to clarify the matter.
- The store may be unavailable during technical failures and maintenance work. If something does not work, write to shop@groundgame.com — preferably with a screenshot. We will respond within 14 days.
- Using the Internet involves typical risks: malware, phishing websites and fake messages impersonating the store, and account takeover. We never ask for your login code, password, or card details via email, SMS, or phone. Payment takes place exclusively on the payment provider page opened from our store. Keep your software updated and never share your login codes with anyone.
FROM CART TO CONTRACT - Prices and product descriptions in the store constitute an invitation to conclude a contract, not an offer within the meaning of civil law. You make the offer by submitting an order.
- You add products to the cart. Adding an item to the cart does not reserve it.
- In the cart, you check the contents, enter a discount code (if you have one), and proceed to checkout.
- You log in or enter your details as a guest, choose the delivery method and payment method.
- Before final confirmation, we show a full summary: what you are buying, how much each item and the total cost, how much shipping costs, and if there are any additional fees.
- You place the order by clicking the "Order and pay" button. Up until this click, you can change everything. By submitting the order, you accept the Terms and Conditions in force on that day.
- You will immediately receive an email confirming that we have received your order. This is not yet a binding contract — we check availability first.
- A second email confirms that the order has been accepted for processing and contains the purchase details. The moment this email reaches you is the moment the contract is concluded.
- Until the second email is sent, we may cancel the order if the details are false or belong to another person, the order was placed automatically, it was not paid for within 7 days, or the product is out of stock. We will always write explaining why.
- If we can only fulfil part of the order, we will contact you to determine the next steps. For items we cannot deliver, we will refund your money within 14 days.
- The contract may be concluded in English; however, the legally binding and governing language of the contract and these Terms and Conditions is Polish. In the event of any discrepancies between language versions, the Polish version shall prevail. We keep you informed about the order status via email, SMS, or telephone.
- The proof of purchase is an invoice issued based on the order details. We send it by email as a PDF file to the email address provided in the order — by placing an order, you agree to receive invoices (including corrective invoices and duplicates) in electronic form. If you prefer a paper invoice, write to shop@groundgame.com — we will send it by postal mail at no extra charge.
HOW MUCH YOU WILL PAY - All prices are gross prices (inclusive of VAT). We quote them in Polish Złoty (PLN). When switching currencies, we show prices in Euros, US Dollars, or Czech Korunas. You then pay in the selected currency, and any refund upon return or complaint will be made in that currency. If your bank converts the payment into another currency, it may charge its own fee — we have no control over this.
- The price does not include delivery, unless a specific promotion states otherwise. You will see the delivery cost before placing the order.
- Promotions cannot be combined with one another unless specific campaign conditions state otherwise. Details are in the "Discount Codes and Promotions" section.
- Available payment methods and their operators can be found in the "Payment Methods" tab and during checkout.
- Certain payment methods may occasionally be unavailable — on our end or on the operator's end. The payment methods available for a given order are displayed during checkout.
- In the case of cash on delivery (COD), you pay the courier. If you select the COD payment method at least three times and fail to make payment upon delivery, your ability to choose cash on delivery may be restricted.
DISCOUNT CODES AND PROMOTIONS - The terms of each promotion and discount code — duration, applicable products, minimum order value, and whether it combines with other discounts — are specified for each campaign: on the store's website, in the newsletter, or where the code is shared.
- You enter the code in the cart or at checkout before submitting your order. If you do not enter it, we cannot apply the discount later — we will not recalculate the price or refund the difference. An exception applies if the code failed due to reasons on our end — in that case, contact us. Only one code can be used per order unless campaign terms state otherwise. Codes cannot be exchanged for cash.
- The discount from a code does not apply to shipping costs unless campaign terms state otherwise.
- If you return part of an order purchased with a discount, we will refund the amount you actually paid for the returned product. A discount covering multiple products — e.g. a storewide code, basket threshold discount, or "buy one get one cheaper" promo — is distributed among those products proportionally to their prices. Any free promotional item received must be returned together with the qualifying purchased product; if you keep it, we will deduct its regular price from the refund amount.
WHEN YOU WILL RECEIVE YOUR PARCEL - We deliver orders to the countries listed in the "Shipping" tab.
- Delivery methods, carriers, costs, and estimated delivery times are listed in the "Shipping" tab and during checkout. Certain delivery methods may be unavailable for some products, e.g. oversized equipment — this is displayed during shipping selection.
- We pack and dispatch the order to the carrier within a maximum of 14 working days. This period runs from the receipt of payment into our bank account, or for cash on delivery — from contract conclusion. Carrier transit times are provided at checkout.
- For shipments outside the European Union, you may be liable for customs duties and import taxes according to the destination country's regulations. These are not included in the price.
TRY IT ON, BUT DO NOT TRAIN IN IT - You can examine and try on everything just as you would in a brick-and-mortar store. Check the size, sleeve length, fabric weave, and overall fit.
- Trying on means checking, not using. In practice, until you decide to keep the product:
– do not step onto the mat or wash kimonos, rashguards, and shorts;
– put on gloves and guards to check the fit, but do not hit punching bags or spar;
– do not submerge mouthguards in boiling water — once boiled and molded to your bite, no one else can purchase or use them;
– do not unpack punching bags, mats, and training equipment more than necessary to inspect them.
DOESN'T FIT? YOU HAVE 14 DAYS - You have 14 days to withdraw from the contract without giving any reason. This is your statutory right under consumer protection legislation — you do not need to justify yourself.
- The withdrawal period is counted from the day on which you or a third party indicated by you takes physical possession of the parcel. For multiple packages — from the delivery of the last package.
- Notify us of your return before the 14 days expire: via the "Withdraw from contract here" button in the website footer, via the withdrawal form (model form found in Annex 1 to these Terms and on the returns page), or by standard email to shop@groundgame.com in your own words.
- The return form also works without an account: enter the email address used for the order, enter the 6-digit code sent to that email, select the order, and submit the return. You can cancel an order that has not been shipped yet in the same way.
- Ship the items back within 14 days of notifying us to: Ground Game — Salon sprzedaży, Centrum Handlowe Nowy Turzyn, Aleja Bohaterów Warszawy 40, premises 2F1, 70-342 Szczecin, Poland.
- You cover the direct cost of returning the goods.
- We refund the price of the products and the standard initial delivery cost to you within 14 days of receiving your notification. If you chose a delivery method more expensive than our cheapest standard option, we only refund the cost of that cheapest option. We may withhold the refund until we receive the goods back or until you supply evidence of having sent them back, whichever occurs first.
- The refund is made using the same payment method used for the initial transaction — unless you expressly agree to receive store credit.
- There is no direct exchange process. Simply return the unwanted product and place a new order for the correct size.
WHAT CANNOT BE RETURNED - The law provides for several statutory exceptions to the right of withdrawal. In our store, this applies in particular to:
– equipment and clothing with custom prints, embroidery, or other personalization made to your individual specifications;
– sealed hygienic goods, including underwear, groin guards, and mouthguards, if the hygienic seal is broken after delivery. For hygiene reasons, once the seal is unsealed, we cannot accept them back;
– dietary supplements and food in sealed packaging if opened after delivery (due to health protection reasons);
– perishable food or items with a short expiration date — this is clearly indicated on the product page.
COMPLAINTS AND STATUTORY WARRANTY - We are liable for ensuring that the goods conform to the contract — match the description, are suitable for their intended purpose, are complete, and possess the quality reasonably expected of such goods.
- We are liable for non-conformity for a period of 2 years from delivery.
- Submit a complaint by email to shop@groundgame.com, via the form after logging into your account, or by postal mail. State what occurred, when you noticed it, and what remedy you seek. The lack of any of these elements does not invalidate the complaint — it merely helps us resolve it faster.
- Do not return the equipment immediately. First, write to us and attach photos. If you cannot take photos, contact us — we will arrange another way.
- Under a complaint, you may demand repair or replacement of the product.
- We will repair or replace the product at our own expense within a reasonable time.
- You may demand a price reduction or withdraw from the contract (refund) if:
– we refuse to repair or replace, or fail to bring the goods into conformity,
– the defect persists despite our repair or replacement,
– the defect is substantial enough to justify immediate reduction or withdrawal (e.g. kimono fabric weight differs from description),
– we state, or it is clear from the circumstances, that we will not repair or replace within a reasonable time or without significant inconvenience to you. - We refund the price reduction amount within 14 days of receiving your statement.
- In the event of withdrawal due to defect, you return the goods at our expense. We refund the price within 14 days of receiving the product or proof of its return.
- We respond to complaints within 14 days. If we fail to reply within this period, the complaint is deemed accepted.
REVIEWS AND CONTENT IN THE STORE - Reviews in the store come from two sources:
- Google Customer Reviews. Customers who opted in after purchase receive a survey from Google. The overall store rating is calculated by Google under its own rules, taking into account other sources — we have no influence over it.
- Product reviews collected within our store via Judge.me. - A product review in our store can only be submitted by a customer who purchased that product from us — we verify this in order history. Such reviews are labeled as "Verified Purchase".
- Some reviews were migrated from the previous store version. There, they were also published after purchase verification. In the current system, they lack the verified tag because it cannot be transferred during data migration.
- We publish both positive and negative reviews. We do not delete reviews merely because they are critical, and we never commission reviews from non-purchasers. The average product rating is the simple arithmetic mean of all published reviews for that product.
- By submitting a review (including photos), you grant us a royalty-free, non-exclusive, worldwide, perpetual license to record, reproduce digitally, and publicly display the review in the store.
- When posting a review or other content, do not submit illegal content or content that:
- is vulgar, offensive, or incites aggression towards individuals or groups,
- infringes third-party copyrights, personal rights, or image rights,
- is misleading or constitutes hidden advertising for another seller,
- contains personal data of other individuals,
- does not relate to the product or purchases with us. - We may remove illegal content or content violating these rules, restrict its visibility, or in serious cases suspend the account. We will always state what action was taken, why, and how you can appeal: by writing to us or taking legal action.
- If you spot content you consider illegal, report it to shop@groundgame.com. In the report, provide: the exact URL, the explanation of why it is illegal, your name, and email address. Also confirm that you are acting in good faith and that the information is true and complete.
- We will acknowledge receipt of the report and communicate our decision without undue delay, wherever possible within 14 days.
- We do not perform automated content scanning. Decisions are made by human reviewers, following a report or manual detection.
- Single point of contact for the Digital Services Act (DSA) — for store users and authorities of Member States, European Commission, and European Board for Digital Services: shop@groundgame.com. We communicate in Polish and English.
NEWSLETTER - The newsletter is an electronic service enabling you to receive commercial information from us, in particular regarding products, stores, new arrivals, and active promotions, sent to your email address with your explicit consent.
- We only send the newsletter to those who subscribed voluntarily. Subscribing is not a condition for making purchases.
- You can unsubscribe at any time — via the link in the footer of any email or by contacting us. We process this immediately.
- What we do with your data is described in our Privacy Policy.
- You are entitled to use newsletter content free of charge exclusively for personal use and for the proper reception of the newsletter, without territorial restrictions. Any other use requires prior express written consent under penalty of nullity.
DISPUTE RESOLUTION - Please write to us first. Most issues can be resolved amicably, which we prefer over formal disputes.
- If we reject your complaint, we will also state in our response whether we agree to participate in out-of-court dispute resolution proceedings, and if so, before which body.
- You may use out-of-court dispute resolution mechanisms:
- mediation before the competent regional trade inspection body (e.g. Provincial Trade Inspection Inspectorate in Poland),
- permanent consumer arbitration courts,
- free assistance from municipal or district consumer ombudsmen,
- assistance from recognized consumer organizations. - The register of entities authorized to conduct out-of-court consumer dispute resolution in Poland is maintained by the President of UOKiK (uokik.gov.pl). Participation is voluntary for both parties.
- If an agreement is not reached, the dispute will be settled by the competent court determined according to applicable law.
AMENDMENTS TO TERMS AND CONDITIONS - We may amend these Terms and Conditions for important reasons: changes in legal regulations or their judicial/administrative interpretation, changes in technical operation of the store, introducing, modifying, or removing features, changes in terms of payment operators or couriers, store security requirements, fraud prevention, or changes in company registration data. We may also introduce editorial corrections — fixing errors, style, layout, or clarity — provided they do not affect your rights or obligations.
- We notify you of changes via email if you have an account or subscribe to the newsletter, and publish the new version in the store. Changes enter into force after 14 days.
- Do not agree? You may terminate your account agreement or unsubscribe from the newsletter during this 14-day notice period.
- Changes will never affect previously placed orders — these are governed by the version in force on the purchase date.
SOLE PROPRIETORSHIP (ENTREPRENEURS WITH CONSUMER RIGHTS) - Do you run a sole proprietorship and buy equipment that is not of a professional nature for you? You are granted consumer rights with us. The professional nature is determined primarily by the scope of your business activity registered in the official business register (such as CEIDG in Poland or the equivalent commercial register in your country).
- In particular, you can withdraw from the contract within 14 days, as described in the "Doesn't Fit? You Have 14 Days" section. Our statutory liability for defects is neither excluded nor limited against you. Unfair contractual terms prohibited towards consumers do not bind you.
- Complaints are handled according to the "Complaints and Statutory Warranty" section. If statutory provisions provide greater rights in your case, they shall apply.
B2B PURCHASES
This section applies exclusively to buyers not covered by the rest of these Terms, i.e., those who are neither consumers nor individuals running a sole proprietorship where the contract is directly related to their business but has no professional nature for them. Hereinafter referred to as Business Clients. - If you are a Business Client, the following clauses take precedence over other provisions of these Terms and Conditions. In all other matters, the Terms apply without changes.
- We may withdraw from a sales contract concluded with a Business Client within 14 days of its conclusion without giving any reason. This does not give rise to any claims on their part.
- We may limit available payment and delivery methods for a Business Client, including requiring full or partial advance payment.
- Upon handing over the goods to the carrier, the benefits, burdens, and risk of accidental loss or damage to the goods pass to the Business Client. We shall not be liable for any loss, decrease, or damage occurring from acceptance for carriage until delivery, nor for transit delays.
- Pursuant to Art. 558 § 1 of the Polish Civil Code, our statutory warranty liability (rękojmia) towards Business Clients is completely excluded.
- Business Clients are not entitled to statutory distance contract withdrawal rights or non-conformity claims described in the "Doesn't Fit? You Have 14 Days" and "Complaints and Statutory Warranty" sections.
- We may terminate the electronic service agreement with a Business Client with immediate effect, without stating reasons, by sending a statement via email or SMS.
- Our liability towards a Business Client — regardless of legal grounds, whether for a single claim or all claims combined — is limited to the amount of the price paid and delivery costs under the last sales contract, not exceeding PLN 1,000. This limitation does not apply to damages caused intentionally.
- Any disputes with Business Clients shall be resolved by the court having jurisdiction over our registered office.
PERSONAL DATA - Providing personal data is voluntary, but necessary to create an Account, use designated electronic services, and conclude a sales contract.
- Detailed information regarding personal data protection is available in the "Privacy Policy" tab.
FINAL PROVISIONS - Matters not regulated herein shall be governed by Polish law — in particular the Civil Code, Consumer Rights Act, and Act on Providing Services by Electronic Means.
- Nothing in these Terms restricts the statutory rights granted to you by mandatory legal provisions of your country of habitual residence (pursuant to Art. 6(2) of Regulation (EC) No 593/2008 - Rome I). Should any provision conflict with them, mandatory statutory provisions shall prevail.
- You can download, print, and save these Terms and Conditions from the store website at any time.
- These Terms and Conditions are effective from 17.11.2026.
